Criteria to qualify for disability benefits due to depression
The general rule to qualify for disability benefits is to suffer from an illness mentioned in the SSA's impairment listing manual. Depression is a condition that falls under the SSA's impairment listing 12.04. However, the SSA will require medical documents that prove your depression, the symptoms, and functional problems of the condition that prevents you from performing work. To receive benefits for depression, the SSA expects you to be affected by at least 5 of the below-listed symptoms:
- Experiencing a depressed mood persistently
- Lack of interest in activities
- Poor appetite leading to weight loss or gain
- Insomnia or irregular sleep patterns
- Lack of focus and indecisiveness
- Feelings of guilt and worthlessness
- Thoughts of self-harm and suicidal thoughts
- Delay in physical movement, physical and mental reactions, etc.
Furthermore, the SSA expects you to have experienced a “marked” limitation in at least two of the following areas and an “extreme” limitation in at least one of the following areas. They are:
- Ability to understand, remember and apply information
- Ability to communicate and interact with others
- Ability to focus, persist and maintain pace while doing a task
- Ability to adapt and manage your life and day-to-day activities, etc
The SSA psychiatrist will review your medical documents against the above-listed criteria before arriving at a final decision. Call our attorney today to win disability for depression.
Can I receive both workers' compensation and SSDI Benefits at the same time?
Yes, you can receive both the benefits simultaneously. However, there is a chance for the SSA to offset the number of disability benefits depending on the amount of workers compensation you receive. If the combined total of your disability benefits and earnings through workers compensation exceed 80% of your original earnings, then the SSA may offset the amount of your disability payment.
Although the good news is that upon the expiration of your workers' compensation, the SSA will increase your disability benefits back to the standard amount. Similarly, if you are receiving income from insurance or privately funded pension, such an income will not affect your social security disability benefits. Does Receiving Retirement Benefits Affect SSDI/SSI?
You have been receiving disability benefits under SSDI and have now reached your retirement age? You will receive both the SSDI as well as the retirement benefits. Similarly, if you are receiving benefits under SSI and have reached the age of 62, you will receive benefits under both SSI as well as the social security retirement schemes.
